These Terms govern access to and use of the Arwa Arabia Dates Factory website, store, and services.
1) Acceptance of Terms
By accessing or using arwaarabia.com (the “Site”) or purchasing our products/services (collectively, the “Services”), you agree to these Terms. If you do not agree, do not use the Services.
2) Accounts & Accuracy
- You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
- You agree to provide accurate, current, and complete information and to keep it updated.
3) Products, Information & Orders
- Product images are for illustration; natural variation in size, color, and texture may occur.
- We may limit or refuse any order at our discretion, including suspected resellers or fraudulent activity.
- Order acceptance occurs when we issue an order confirmation or ship the product, whichever is earlier.
4) Pricing, Currency & Taxes
- Prices are shown in SAR unless stated otherwise and may change without notice prior to order acceptance.
- Applicable taxes, duties, and fees are the customer’s responsibility unless explicitly included at checkout or in a written quotation.
5) Shipping, Delivery & Risk of Loss
- Dispatch times and delivery windows are estimates only and not guaranteed.
- Risk of loss and title transfer to you upon our delivery to the carrier (EXW/FCA terms apply unless otherwise agreed in writing).
- You must provide a complete and accurate delivery address (e.g., National Address in KSA). Re-delivery/storage fees may apply for failed delivery.
- Inspect packages upon receipt and notify the carrier and us of any visible damage within the carrier’s claim window.
6) Returns, Refunds & Replacements
- Due to the perishable nature of dates and date derivatives, returns may be limited. Any return/replacement is subject to our quality review and applicable laws.
- Contact support promptly with order number, photos, and description of the issue. We may offer replacement, credit, or refund at our discretion.
7) B2B & Industrial Supply
- Specifications (e.g., grade, moisture, sizing, defect tolerances) are per the signed quotation/PO and reasonable industry tolerances.
- Samples/COA are indicative; Arwa Arabia does not warrant fitness for a particular purpose unless expressly agreed in writing.
- For shipments under Incoterms (EXW/FCA/FOB/CIF/DAP/DDP), the agreed Incoterm governs responsibility, risk, and documentation.
8) Disclaimers — No Warranties
To the maximum extent permitted by law, the Services and all content and products are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including without limitation implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free operation, or that defects will be corrected.
9) Limitation of Liability
To the maximum extent permitted by applicable law:
- Arwa Arabia, its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or business interruption, arising out of or related to the Terms or the use of (or inability to use) the Services, even if advised of the possibility of such damages.
- In no event shall Arwa Arabia’s aggregate liability for all claims exceed the amount you actually paid to Arwa Arabia for the product or service giving rise to the claim during the twelve (12) months immediately preceding the event first giving rise to liability.
- Some jurisdictions do not allow certain limitations; in such cases, the above limitations apply to the fullest extent permitted by law.
10) Indemnification
You agree to defend, indemnify, and hold harmless Arwa Arabia and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your misuse of the Services, breach of these Terms, or violation of any applicable law or third-party rights.
11) Intellectual Property
- All content on the Site (including text, images, logos, and designs) is owned by or licensed to Arwa Arabia and protected by applicable laws.
- You may not copy, modify, distribute, or create derivative works without prior written consent.
12) Acceptable Use
- No unlawful, fraudulent, or harmful activity; no interference with the Site’s operation; no attempts to circumvent security.
- No posting or transmitting of harmful code, spam, or infringing/defamatory content.
13) Third-Party Services & Links
The Site may link to or integrate third-party services (e.g., payment gateways, couriers). We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.
14) Force Majeure
We shall not be liable for any delay or failure to perform due to events beyond our reasonable control, including but not limited to acts of God, extreme weather, fire, flood, epidemic, war, terrorism, labor disputes, embargoes, power failures, internet failures, carrier or customs delays, or government actions.
15) Governing Law & Dispute Resolution
- These Terms are governed by the laws of the Kingdom of Saudi Arabia, without regard to conflict-of-laws rules.
- Courts located in the Kingdom of Saudi Arabia shall have exclusive jurisdiction over any dispute, unless we agree to an alternative forum or arbitration in writing.
16) Changes to Terms
We may update these Terms from time to time. Updates take effect upon posting on the Site, unless a later effective date is stated. Your continued use after changes means you accept the updated Terms.
17) Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect and use personal data.

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
